A 78-year-old Cheyenne man is facing first-degree murder charges according to the Wyoming Tribune Eagle.
Charles S. Richmond is accused of shooting and killing 41-year-old John-Paul Birgenheier on December 5th.
According to court documents, the two were in a verbal altercation over the property.
The altercation escalated when Richmond returned from his home with a shotgun.
He allegedly shot Birgenheier three times. Court documents show that when police responded Richmond admitted his crime and expressed that he “was sorry.”
Richmond’s attorney asked a judge to dismiss the case, saying the evidence was insufficient to show premeditated murder. The judge said there was enough evidence to support first-degree murder charges.
Richmond is being held on $100,000 cash bond. The investigation is still ongoing.
