On May 12th just after 1:30 p.m. a Fremont County Sheriff’s Deputy initiated a traffic stop on a vehicle after making a left turn into a parking lot on North Federal Boulevard in Riverton.
Because of the current construction in the area, left turns are not allowed, indicated by multiple signs through the construction.
The driver was identified as 53-year-old Timmothy Burke. While in contact with Burke, the Sheriff’s Deputy smelled an alcoholic-type odor emitting from the truck and noted in court documents that Burke’s eyes were bloodshot and glassy, he also spoke with a thick slurred speech.
Burke agreed to preform a standard field sobriety test, which court documents say he failed.
A check of Burke’s blood alcohol content revealed a .202% reading. At that point, he was placed under arrest for driving under the influence.
A records check indicated that Timmothy had 3 previous DUI charges over the last 8 years, in 2011, 2012, and 2017.
Burke is now facing two counts of felony DUI. The enhanced penalty for both charges, based on previous convictions, is up to 10 years of imprisonment and a fine of up to $10,000. Additionally, he faces one count of driving while license cancelled, suspended, or revoked. That charge is punishable by up to 6 months of prison and a $750 fine.
On May 24th, the Circuit Court found probable cause to transfer the matter to District Court for further proceedings and arraignment.
All suspects are innocent until proven guilty in a court of law.
