In 2019, the state of Utah implemented a new legal limit for drinking and driving.
The penalty used to penalize drivers with a blood alcohol content level of 0.08 or higher. The new rules penalize drivers with a BAC of 0.05 or higher.
The first to be arrested under the new threshold was a Wyoming man, not identified, who was arrested on Tuesday morning. An initial BAC test showed the man to be slightly above a 0.08, but a test later that is admissible in court showed that he measured at .059.
According to an Associated Press report, Utah’s new BAC threshold is the lowest in the United States.
Critics say it penalizes drivers, supporters say it’s a public safety measure.
