All suspects are presumed innocent until proven guilty in a court of law.
(Riverton, WY)—Former Riverton Police Department (RPD) officer Logan Alley’s sentencing hearing has been set for December 19 in Lander’s District Court.
The hearing was scheduled following an October 10 arraignment hearing overseen by the Honorable Judge Jason Conder, Court documents filed on October 17 state.
Alley was charged with felony possession of a schedule III controlled substance (Trenbolone Enanthate in liquid form) back in August, following an investigation that began after a U.S. Postal Inspection Service Inspector observed he had received several “suspicious” parcels that were “associated with Darknet vendors and other controlled substance seizures.”
After the case was bound to District Court in September, a plea agreement was later filed on Alley’s behalf on October 3.
The agreement stipulated that in consideration of a guilty plea, Alley’s conviction would “not be entered and shall be deferred pursuant to WY Statute § 35-7-1037.”
The Statute states that “any person who has not previously been convicted of any offense under this act,” in this case as it relates to the possession of a “controlled substance,” the Court may “defer further proceedings and place him on probation upon terms and conditions.”
“Upon fulfillment of the terms and conditions, the Court shall discharge the person and dismiss the proceedings against him,” the Statute informs.
The plea agreement also stated that the Prosecution and Defense agreed Alley would be “placed on supervised probation for 18 months, unless sooner discharged by the Court.”
Alley’s “guilty” plea was conditionally accepted but not entered at the October 10 arraignment, an Order After Arraigment document filed on October 17 states, and no conviction was entered.
The pre-sentence investigation report was ordered to be filed on December 9, and the December 19 sentencing hearing was set.
